You must first sign up for Online Banking before you enroll in Bill Payment. If you are already an Online Banking client, simply log in to Online Banking and click on the "Bill Payment" button. Complete and submit an online application. You will receive an e-mail notifying you when the account is ready for Bill Payment.

Internet Banking Agreement and Disclosures

Coverage. This Agreement applies to your use of our Internet Banking Service ("Internet Service"), which permits you to access your accounts with us via the Internet for services selected by you and agreed upon by us. This Agreement applies to all persons that are parties to the accounts. In this Agreement, the terms "you" and "your" refer to each depositor on an account accessible by Internet Service, and the terms "us," "we," and "our" refer to the Bank.

Enrollment/Application Forms. To establish Internet Service you will complete certain enrollment forms or other documents evidencing your desire to access your accounts using the Internet Service. When you select the “I Agree” button and when you use, or permit any other person(s) to use, Internet Services, you agree to the terms and conditions of this Agreement. Additional information relating to Internet Service is included in the on-line manual or instructions provided to you and incorporated into this Agreement.

Your Responsibility. You are responsible for selecting all systems, hardware and your Internet Service provider and for any defect, malfunction or interruption in service or security due to hardware failure, your choice of Internet Service provider and systems and computer services.

Access Codes. We will either issue to you, or you will be required to select one or more personal identification numbers, passwords, or other access codes ("PIN") to access services using Internet Service. For security purposes, you are required to change your PIN after the initial login. You determine what PIN you will use and the identity of your PIN is not communicated to us. You agree that we are authorized to act on instructions received under your PIN. The PIN has the same effect as your signature authorizing transactions. You agree to safely keep the PIN, not to record the PIN or otherwise disclose or make the PIN available to anyone other than authorized users of your accounts. Anyone to whom you disclose your PIN and anyone who has access to your PIN will have full access to the services you can perform on Internet Service, including full access to your accounts. You have no ability to limit any such person's authority. If anyone uses your PIN with your permission, you will be responsible for any transactions performed by that person. After three (3) unsuccessful attempts at authorization to use the system, you must contact us to have your PIN reset or to obtain a new temporary PIN. You agree to assume responsibility for all transactions up to the limits allowed by applicable law.

Customer Liability. Tell us at once if you believe your PIN has been lost, stolen or otherwise become available to an unauthorized person. Telephoning is the best way of keeping your possible losses down. You could lose all the money in your accounts (plus your maximum overdraft line of credit). If you tell us within two business days, you can lose no more than $50 if someone used your PIN without your permission. If you do NOT tell us within two business days after you learn of the loss or theft of your PIN, and we can prove that we could have stopped someone from using your PIN without your permission, you could lose as much as $500.

Also, if your statement shows transfers that you did not make, tell us at once. If you do not tell us within 60 days of the date we mail a periodic statement to you, you may not get any money you lost after the 60 days if we show that we could have stopped someone from taking the money if you would have told us in time. If a good reason (such as a long trip or a hospital stay) kept you from telling us, we will extend the time periods.

Contact in Event of Unauthorized Transfer. If you believe your PIN has been lost or stolen or that someone has transferred or may transfer money from your account without your permission, call (920) 863-2161 or write Denmark State Bank, 103 E. Main St., P.O. Box 130, Denmark, WI, 54208.

Business Days. The Internet Services are available 24 hours a day, seven days a week, except during special maintenance periods, which generally are scheduled between 11:00 p.m. Sunday night and 4:00 a.m. Monday morning. For purposes of transactions, Denmark State Bank’s business days are Monday through Friday, except federal holidays. All Internet Service transaction requests received after 5:00 p.m. central time on business days, and all transactions which are requested on Saturdays, Sundays or holidays on which Denmark State Bank chooses to remain closed, will be processed on the next Denmark State Bank business day. Denmark State Bank’s business day begins at 9:00 a.m. If you schedule a recurring funds transfer and the payment date does not exist in a month, the payment will be processed on the next business day.

Functions. Using your PIN and the Internet Service you can:

  • Funds Transfers. You may use Internet Service to perform unlimited funds transfers from your Denmark State Bank checking accounts or savings accounts to other Denmark State Bank checking accounts or savings accounts. You may also transfer from your Denmark State Bank checking or savings account to make loan payments. You may also transfer from your Denmark State Bank lines of credit to your Denmark State Bank checking accounts or savings accounts. Note: This Agreement imposes no restrictions on the number of transactions from Denmark State Bank accounts or the amounts which may be transferred, but certain limits and restrictions on the frequency of transfers may be applicable with respect to the particular types of accounts subject to this Agreement, particularly Statement Savings and Money Market Checking . Please refer to the disclosure documents you received at the time these accounts were established for more detailed information on limitations and restrictions applicable hereto.
     
  • Balance Inquiries. You may use Internet Service to check the current balance and other account information on deposit accounts and loan accounts.
     
  • Customer Service. You may communicate with Denmark State Bank by using your personal computer to send and receive written messages electronically. Please refer to the "Contact Us" option to send us your comments, questions or concerns.
     
    New services may be introduced for Internet Service from time to time. Denmark State Bank will notify you of the existence of these new services. By using these services when they become available, you agree to be bound by the rules that will be made available to you concerning these services.

Overdrafts. When you schedule a funds transfer using the Internet Service, you authorize us to withdraw the necessary funds from your account with us. We deduct the amount of your funds transfer from your account on the date we process your instruction. Each instruction to us to withdraw or transfer from an account is an order to us to pay from that account at that time or on a later date, if any, indicated in the instruction. We may charge payments against the account even though the charge creates an overdraft, or we may refuse to make payments if the charge creates an overdraft. If you overdraw your account, you agree to immediately pay us the overdrawn amount, together with any applicable fees. If the account is maintained in connection with an overdraft credit plan, any overdraft will be made in accordance with the agreement or rules governing that account rather than this Agreement.

Limitations on Transfers. Under federal regulations, you may make no more than six preauthorized electronic fund transfers and telephone transfers, including Internet Service transactions, checks and point-of-sale transactions per month from your savings or money market deposit account. Of these six transactions, you are limited to no more than three transactions per month by check, draft, debit card or similar order to third parties. Each fund transfer through Internet Service from your savings or money market deposit account is counted as one of the six limited transfers you are permitted each month. (However, payments to your loan accounts with us are not counted toward this limit for savings and money market deposit accounts.)

Periodic Statements. Your Internet Service account activity will appear on your periodic account statement. If there are no transfers in a particular month, you will receive statements at least quarterly.

Our Liability For Failure to Make Transfers. If you have given us all of the proper and timely instructions and have properly completed all fields to complete a transfer, and we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, subject to the limitations contained in this Agreement, we will be liable for your losses or damages proximately caused by our failure. However, there are some exceptions. We will not be liable, for instance:

  • If, through no fault of ours, your account does not contain sufficient collected funds to make the transfer.
     
  • If the money in your account is subject to legal process or other encumbrances restricting the transfer.
     
  • If the transfer would go over the credit limit on your overdraft credit plan, if any.
    If a transfer system was not working properly and you knew about the breakdown when you started the transfer.
     
  • If an act of God or circumstances beyond our control (such as fire or flood) prevent the transfer or use of Internet Service despite reasonable precautions that we have taken.
     
  • If incomplete or inaccurate information is forwarded to us by you or through an automated clearinghouse.
     
  • If you have not provided us with complete and correct payment information, including without limitation the name, address, account number and payment amount for the payee on a bill payment.
     
  • If you have not properly followed the instructions for using the Internet Service.
     
  • If your operating system is not properly installed or functioning properly.
     
  • For errors or failures from any malfunctions of your browser, internet service provider, computer, computer virus or other problems relating to the computer equipment you use with the Internet Service, including, without limitation, your inability to access Internet Service or any part of Internet Service.
     
  • If we have a reasonable basis for believing that unauthorized use of your PIN or account has occurred or may be occurring, or if you default under this Agreement, the Deposit Account Agreement, a credit agreement, or any other agreement with us, or if we or you terminate this Agreement.
     
  • For a failure to provide access or for interruptions in access to the Internet Service due to Internet Service system failure.
     
  • NOTWITHSTANDING ANY OTHER PROVISION IN THIS AGREEMENT, UNLESS OTHERWISE PROHIBITED BY LAW, OUR SOLE RESPONSIBILITY FOR AN ERROR BY US OR OUR THIRD PARTY PROVIDER IN TRANSFERRING FUNDS WILL BE TO CORRECT THE ERROR AND PAY ANY PENALTIES AND ASSOCIATED LATE CHARGES TO THE PAYEE (UP TO A MAXIMUM OF $50.00 PER PAYMENT), BUT IN NO CASE WILL THE BANK BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH OR IN ANY WAY RELATED TO INTERNET SERVICE.

Account Information Disclosure. We will disclose information to third parties about your account or the transfers you make, as permitted by law, including, without limitation: where it is necessary for completing or tracing transfers or resolving errors or claims; in order to verify the existence and condition of your account for a third party, such as a credit bureau or merchant or other financial institution; in order to comply with court orders or other legal process; to comply with subpoenas, summonses, search warrants or requests from government agencies; to other companies affiliated with us; to others with your consent; and whenever required by law; and to companies that perform marketing services on our behalf or to other financial institutions with whom we have joint marketing agreements.

You agree that we may deliver our privacy notices and opt-out notices to you by making them available on our web site.

Electronic Mail. If you send Denmark State Bank an electronic mail message, Denmark State Bank will be deemed to have received it on the following business day. Denmark State Bank will have a reasonable time to act on your e-mail.

You should not rely on electronic mail if you need to communicate with Denmark State Bank immediately (e.g., if you need to report an unauthorized transaction from one of your accounts, or if you need to stop a payment that is scheduled to occur).

You agree that Denmark State Bank may respond to you by electronic mail with regard to any matter related to the Internet Service, including responding to any claim of unauthorized electronic funds transfer that you make. Any such electronic mail sent to you by Denmark State Bank shall be considered received within three (3) days of the date sent by Denmark State Bank, regardless of whether or not you sign on to the Internet Service within that time frame.

Termination. We may modify, suspend or terminate your privilege of using Internet Service and may withhold approval of any transaction, at any time, without prior notice to you. In the event we terminate Internet Service, we will try to notify you in advance but are not required to do so. You will be notified as soon as practicable. Any one person who can use the account accessible with Internet Service may terminate Internet Service. Termination shall not affect the rights and obligations of the parties for transactions made with the Internet Service before we have had a reasonable time to respond to your termination request.

You may cancel your Internet Service by calling us at (920) 863-2161 or writing Denmark State Bank, 103 E. Main St., P.O. Box 130, Denmark, WI, 54208 or by sending a message through Internet Service. If you call or e-mail, we may also require you to put your request in writing. Since service cancellation requests can take up to 10 days to process, you should cancel all transfer orders in addition to notifying us of your desire to terminate the service. We will not be liable for transfers not cancelled or transfers made due to the lack of proper notification by you of service termination or discontinuance for any reason. Once we terminate your Internet Service any pending transfers will be terminated.

We may convert your account to inactive status if you do not sign on to the Internet Service or have any transaction scheduled through the Internet Service during any consecutive sixty (60) day period. If your account is considered inactive, you must contact us to have the Internet Service activated before you will be able to schedule any transaction through the Internet Service.

Third Parties. You understand that support and services relating to Internet Service are provided by third parties other than us, and you authorize us to contract with third parties to provide such support and service.

Amendment. Denmark State Bank may modify the terms and conditions applicable to the Internet Service from time to time upon mailing or delivering a notice of the modifications to you at the address shown on our account records or e-mail address we currently possess in our file. Amendments will be effective upon the date indicated in the notice. We reserve the right to terminate this Agreement and your use of the Internet Services in whole or in part at any time without prior notice. We may amend this Agreement at any time.

Fees. We will not charge any fee for using Internet Banking. You will be charged the regular transaction fees that may be in effect for your Denmark State Bank accounts. These fees may be amended by us from time to time.

E-statement. If you enrolled in e-statements also known as online statements, you authorize us to deliver the requested statement(s) via electronic mail. You also acknowledge that we will not deliver the requested statement(s) via traditional mail. We will consider the statement delivered if no return e-mail is received. If, however, a return notice is received by the bank, a statement will be sent via traditional mail. You understand that it is your responsibility to notify us if your e-mail address changes. We will notify you by e-mail when your electronic statement is available for viewing. We also reserve the right to begin sending hard copies of your statement in the mail. Even though e-mail statement files are encrypted you acknowledge that the Internet is inherently insecure and that all data transfers, including electronic mail, occur openly on the Internet and potentially can be monitored and read by others. We cannot and will not warrant that all data transfers utilizing e-mail statements, or mail transmitted to and from us, will not be monitored or read by others. This agreement may be terminated by contacting Denmark State Bank in writing at: P.O. Box 130, Denmark, WI 54208-0130 or calling us at (920)863-2161. Statements will be available for a period of 12 months via our Internet Banking System. After the 12 month period, you will need to contact us and request a copy of your statement. You understand that your statements will include information concerning both your share of deposit and loan accounts with the bank and may include disclosures required under the Truth-In-Lending Act, the Electronic Funds Transfer Act, the Truth-In-Savings Act and/or similar disclosure laws. You agree to the receipt of these disclosures in electronic format as described herein.

Your consent, which will be given by clicking on the “I AGREE” button on the online agreement and selecting the e-statement option within the online application, is to authorize Denmark State Bank to forward to you electronically your periodic bank statements and other disclosures that the bank might send to you with your bank statement.

Note: You will receive the e-mail notification from Denmark State Bank Notification. Please remember to add notification@denmarkstate.com to your list of allowed senders.

General. This Agreement is intended to supplement and not to replace other agreements between you and us relating to your accounts, including, without limitation, our Deposit Account Rules. In the event of a conflict between this Agreement and any other account rules and agreements that apply to your accounts, this Agreement shall govern and prevail.

Additional Provisions. To help enhance your Internet Service security, we recommend that you follow some general safety guidelines:

  • Never walk away from your computer while logged on to this service.
    Memorize your PIN.
  • Don’t share your PIN with anyone.
  • Choose a PIN that’s not easy to guess. For example, use a minimum of six characters with a combination of numeric and alpha characters, and do not use names of family members or pets alone or followed by a number. Words in a dictionary, derivatives of user Ids and common characters sequence such as “12345678” should not be employed. Likewise, PINs should not contain proper names, geographic locations, common acronyms, slang or personal details such as spouse’s name, license plate, social security number, and birthday. Choosing a PIN that contains at least one lower case and one upper alphabetic character and the use of non-alphabetic characters where feasible such as a numeral (0-9) or punctuation character is strongly recommended.
  • Never give your PIN to somebody else, even if they identify themselves as a Denmark State Bank employee. Under no circumstances do we need your PIN.

In Case of Errors or Questions about Your Electronic Transfers

Telephone us at (920) 863-2161 or write us at Denmark State Bank, 103 E. Main St., P.O. Box 130, Denmark, WI, 54208 as soon as you can, if you think your statement or receipt is wrong or if you need more information about a transfer listed on the statement or receipt. We must hear from you no later than 60 days after we sent you the FIRST statement on which the problem or error appeared.

  1. Tell us your name and account number (if any).
  2. Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.
  3. Tell us the dollar amount of the suspected error.

If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days.

We will determine whether an error occurred within 10 business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate your complaint or question. If we decide to do this, we will credit your account within 10 business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may not credit your account.

The 10 day periods in the preceding paragraph may be extended to 20 business days, if the error involves a transfer to or from the account within 30 days after the first deposit to the account was made.

If the error involves an electronic transfer from your account to buy goods or services direct from a merchant, a transfer initiated outside of the United States or a transfer that occurred within 30 days after the first deposit to the account was made, the 45 day time period to investigate your complaint or question will be 90 days in place of 45 days.

We will tell you the results within three business days after completing our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation.

Receiving Online Banking Disclosures. You agree to receive the Denmark State Bank Internet Banking Agreement and Disclosure electronically. If you are enrolling in an office, your customer service representative will provide you with a paper copy of the Denmark State Bank Internet Banking Agreement and Disclosure.

You also agree to receive all updates to the Denmark State Bank Internet Banking Agreement and Disclosure, notices and other communications regarding online banking and bill payment services electronically. If you change your e-mail address, please sign on to Internet Service and update your e-mail so that we can alert you to any such updates. You can request free paper copies of any of these documents by calling 920-863-2161 or sending an e-mail to info@denmarkstate.com.

Giving Your Consent.

  • You agree to receive the Denmark State Bank Internet Banking Agreement and Disclosure electronically. Or if you are enrolling at a branch office, you acknowledge receipt of the Denmark State Bank Internet Banking and Disclosure.
     
  • You represent that the computer and Internet browser you intend to us meets our minimum requirements.
     
  • You have reviewed and agree to the terms and conditions of the Denmark State Bank Internet Banking Agreement and Disclosure.
     
  • You agree to receive all updates to the Denmark State Bank Internet Banking Agreement and Disclosure, all notices, disclosures and other communications regarding online banking and bill payment services electronically.
